HRPAY 16-12, Wounded Warriors Federal Leave Act of 2015

Summary

A new leave category, Disabled Veteran Leave, is being added as a result of the Wounded Warriors Federal Leave Act of 2015, Public Law 114-75. This leave is only available to Federal employees who are Veterans with a service-connected disability rated at 30 percent or more and are employed by a Title 5 Agency, or covered by the Title 5 leave provisions, and have been hired on or after November 5, 2016.

Implementation

Disabled Veteran Leave provides immediate access to 104 hours for a new Federal employee (hired in a covered cilvilian position on or after November 5, 2016) who is a Veteran with a service-connected disability rated at 30 percent or more, for the purposes of undergoing medical treatment for their disability. If the employee is reinstated after a break in service or transferred and has a sick leave credit balance when they are hired, the amount of Disabled Veteran Leave will be reduced by the amount of sick leave that the employee has available on the first day of reemployment. Part-time non-seasonal and full-time or part-time seasonal employees' leave will be prorated based on the employee's tour of duty. Any Disabled Veteran Leave credited to an employee that is not used during the first 12 months of employment and/or reemployment shall be forfeited.

Disabled Veteran leave will only be available to an eligible employee hired on or after November 5, 2016. The term hired refers to employees who are:

The new Remark Code 30V, Employee is entitled to disabled Veterans leave, the current balance is _ _ as of _ _. Employee's beginning date of entitlement for disabled veterans leave is _ _, should be used before the leave is forfeited.

Note: Remark Code 30V should only be used for separating employees.

Front-End System Interface (FESI)

The Payroll Enterprise Human Resources Integration (EHRI) File will be modified to add the new data element, SICK-LV-SET-ASIDE-BAL (Disabled Veteran Leave) to the end of the Bi-Directional Biweekly webTA file and Paycheck8 Daily and Biweekly File.

Note: FESI's Time and Attendance (T&A) Data File will not be modified.

History Correction Packages

For History Correction packages, Agencies must use the Time Inquiry - Leave Update System (TINQ) to update the Disabled Veteran Leave or the start date (YYMMDD) of the Disabled Veteran Leave since the history correction process will not update this information. Refer to the applicable bulletin and/or procedure located in the Research and Inquiry (Inquiry) category for detailed information.

Note: This new leave category may only be used within a continuous 12 month period beginning on the first day of employment/reemployment and may not exceed 104 hours; however, some employees with an uncommon tour of duty may exceed 104 hours.
